These Terms and Conditions cover online shopping with Luxe and specifically our website.
Please note that by accessing, using or browsing this website you agree to be bound by its terms, conditions, disclaimers and limitations of liability ("Terms of Sale"). Luxe reserves the right to amend or update such terms, conditions, disclaimers and
limitations of liability at any time. We will not be providing notice of any change and by using the website, you acknowledge that you have read and understood these Terms.

When you access another Website, that Website is independent from Luxe, and we have no control over the content on that other Website. Any link to another Website is provided as a service to our customers and you must take your own precautions to ensure that any other Website that you access by link from this Site is free from material of a destructive nature. monitor or review statements made or products offered on other sites by third Parties.
Product information in relation to products referred to in this Site has been provided by the respective manufacturers. Product information, photographs and illustrations are published with the permission of the supplier of that product.

All care is taken to ensure that the Luxe website is free from computer viruses. However, it is your responsibility to scan any data or linked websites for viruses.

The name Luxe is registered. Material on this website also comprises copyright material, trademarks and registered trademarks which are the property of Luxe and third parties. This property may only be used for the purposes of browsing the Luxe website and acquiring goods and services from the website.

You expressly acknowledge and agree that Luxe does not control other users of this website, the providers of information to this website or the suppliers of goods and services purchased from this website. Luxe is therefore not liable for their opinions or their conduct, including any information or advice provided by them.
Prices of goods and services,
postage and handling fee, and other charges displayed on the Luxe website are current at the time of being displayed. These prices are subject to change without notice.
There is unlikely to be discrepancies with descriptions or pricing. However, some elements of on-line trading are outside of our control and we are unable to warrant that any content of the website is accurate, current or error free.
If we have to cancel an order, for whatever reason, we reserve the right not to provide goods or services, terminate membership accounts, remove or edit content or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms of Sale detailed in our Terms and Conditions.
If you need to cancel an order, please contact us immediately by emailing us at info@luxewhitsundays.com and no later than 1 working day after placing your order. We will then let you know by email, that we have received your request to cancel your order. Agreement with you only comes into existence once we have both confirmed your order and your payment has been processed. Once we have accepted payment for an order, cancellation of the order is within our sole discretion. Orders that cannot be cancelled will be subject to our terms, conditions and policies relating to Returns and Exchanges.
IN-STORE PICK UP:
We offer free in store pick up (click & collect) from our boutique in Bowen. Once your order is ready you will receive and email. Our boutique is located at 39a Williams Street, Bowen Qld 4805.
SHIPPING METHODS:
We ship using Australia Post.
Please Note: processing delays due to; public holidays, severe weather and courier transit errors are not within our control.
- Order before 12pm AEST Monday – Friday and your order will be sent same day.
- Orders placed on public holidays will be sent the next business day.
- An email will be sent to you with a tracking number as soon as your parcel is packed and dispatched. This tracking number may take up to 12 - 24 hours to activate after it's first scanned by Australia Post.
- We are a regional business, parcels will arrive within 3+ business days.
- Once a parcel leave our boutique, we are no longer liable for that parcel being lost or damaged in transit.
- Above suggested shipping times are a guide only and can vary depending on locations and circumstances.
DELIVERIES
We will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.
INCORRECT ADDRESSING
It is your obligation to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.
Please note that if an item has been lost in transit, we will not dispatch a replacement item immediately. Replacement items will be dispatched according to our discretion.
LATE DELIVERY
Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from a late delivery, you agree that a late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order.
If you are not completely happy with your purchase, please read our returns policy and conditions carefully to ensure you are eligible to return.
- Wrong Size or Change of mind - Items must be returned within 14 days from the date of purchase in new and unused condition with all original labels/tags attached
- Items must be unaltered, undamaged (unless existing fault on item) and unwashed Free from any markings, make-up, self tanner, odours, pet hair, perfumes, deodorant and washing powder.
- For health reasons and personal hygiene, swimwear, underwear, activewear, bodysuits, bralettes, earrings and beauty products are not eligible for return.
- Shoes must be tried on indoors and have no scuff marks.
Faulty item - Item must be returned within 14 days with receipt. Items will be assessed over 24 business hours so Luxe can liaise with the relevant supplier/designer.
We do not accept returns on the following items:
- Products marked Sale/Clearance/ Final Sale
- Accessories
- Jewellery
- Intimates
- Beauty Items

TERMS & CONDITIONS FOR RETURNS
FAULTY PRODUCTS:
We will offer a refund, store credit or an exchange (subject to availability) on any item purchased from Luxe if the garment:
- Has a genuine manufacturing fault; and/or,
- Does not correspond with descriptions given to you.
A faulty item claim must be made within 14 days of purchase. Please email your order number, a description and photo of the fault to info@luxewhitsundays.com - You can expect to hear back from us within 1- 2 business days.
Please note any refund for a faulty garment must be credited to the original card or account used at the time of purchasing the garment.
If your preference is an exchange of product, but we do not hold stock of the same type or size, we are able to offer you a refund or a store credit to the value of the original purchase price of the garment.
If a fault does not amount to a major failure in the garment, we are entitled to elect between providing you with a repair, replacement or other remedy.
WRONG SIZE OR CHANGE OF MIND:
Subject to compliance with the above timeframes for returns, we will offer a store credit in the form of a gift card for a change of mind or for incorrect sizing if:
- The garment has not been worn, altered and/or washed and is in pristine condition so that it can be re-sold.
- The garment has not been damaged whilst in the customer's possession or during delivery.
- The customer has proof of the garment purchase.
- The original labels and swing tags are attached to garment.
Note: ‘damage’ may include the presence of any fake tan, make up or other marks and the presence of the smell of cosmetics, perfume, deodorant, washing powder or other product and odours on the garment.
Additionally, If you have placed your order through AfterPay, your AfterPay payments will continue as scheduled until the full amount is paid for or until your return has processed and your store credit issued, whichever occurs first.
HOW TO RETURN AN ITEM
IN STORE PURCHASE: You will need to bring the item into the boutique at 39a Williams Street, Bowen Q 4805, along with proof of purchase. If you are unable to return to the store of purchase please email us at info@luxewhitsundays.com for further instruction.
ONLINE PURCHASE: You need to email or contact us prior to sending your return. Email: info@luxewhitsundays.com
You must complete the Returns form emailed to you and enclose it with the goods you are returning.
